The Service/Retirable, Inc. is only intended for Consumers.
Terms of Use
User Requirements
By using Retirable, Inc., Users confirm they:
- Qualify as Consumers
- Are not located in countries subject to U.S. Government embargo
- Are not designated by the U.S. Government as “terrorist-supporting”
- Are not listed on U.S. Government prohibited or restricted parties lists
Content Ownership
All content on Retirable, Inc. is owned or provided by the Owner or its licensors. The Owner makes reasonable efforts to ensure content doesn’t infringe applicable laws or third-party rights.
Intellectual Property Rights
Users may not copy, download, share, modify, translate, transform, publish, transmit, sell, or create derivative works from content without permission. Users may only download, copy, and share content for personal, non-commercial use when explicitly permitted.
External Resources
The Owner has no control over third-party resources accessed through Retirable, Inc. and is not responsible for their content or availability.
Acceptable Use
Users are solely responsible for ensuring their use complies with applicable law and third-party rights. The Owner reserves the right to deny access or terminate service if Users:
- Violate laws, regulations, or these Terms
- Infringe third-party rights
- Considerably impair the Owner’s legitimate interests
API Usage Terms
Users may access their data via API under these Terms. The Owner bears no responsibility and shall not be held liable for any damages or losses resulting from the User’s use of the API.
Liability and Indemnification
Disclaimer of Warranties (US Users)
Retirable, Inc. is provided strictly on an “as is” and “as available” basis. The Owner disclaims all conditions, representations, and warranties — express, implied, statutory, or otherwise — including merchantability and fitness for a particular purpose.
The Owner does not warrant:
- Content accuracy, reliability, or correctness
- Service availability at particular times or locations
- Uninterrupted or secure Service operation
- Defect or error correction
- Freedom from viruses or harmful components
Users download content at their own risk and are solely responsible for resulting damage to systems or data loss.
Service Disclaimers
The Owner does not warrant, endorse, guarantee, or assume responsibility for third-party products or services advertised through the Service. The Owner is not a party to third-party transactions.
The Service may not function properly with all browsers, devices, or operating systems. Federal law and some states do not allow exclusion of certain implied warranties; these disclaimers may not apply in all jurisdictions.
Limitations of Liability (US Users)
To the maximum extent permitted by law, the Owner is not liable for:
- Indirect, punitive, incidental, special, consequential, or exemplary damages
- Loss of profits, goodwill, use, data, or intangible losses
- Damage from hacking, tampering, or unauthorized access
- Content errors, mistakes, or inaccuracies
- Personal injury or property damage from Service access or use
- Unauthorized access to secure servers or personal information
- Transmission interruption or cessation
- Bugs, viruses, trojan horses, or malware
- Content errors or losses from content use
- Defamatory, offensive, or illegal User or third-party conduct
Liability is capped at the amount paid by User in the preceding 12 months or agreement duration, whichever is shorter.
These limitations apply regardless of whether liability is based on contract, tort, negligence, strict liability, or other grounds. Some jurisdictions don’t allow exclusion of incidental or consequential damages; limitations may not apply in all locations.
Indemnification
Users agree to defend, indemnify, and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, partners, suppliers, and employees harmless from claims, damages, obligations, losses, liabilities, costs, and expenses — including legal fees — arising from:
- User’s Service use and access
- Violation of these Terms
- Violation of third-party rights, including privacy and intellectual property
- Violation of statutory law, rules, or regulations
- Content submitted from User’s account
- Willful misconduct
- Statutory violations by User or affiliates
Common Provisions
No Waiver
The Owner’s failure to assert any right or provision does not constitute a waiver of that right or provision. No waiver is deemed a continuing waiver of other terms.
Service Interruption
The Owner reserves the right to interrupt Service for maintenance, updates, or other changes with appropriate notice. The Owner may suspend or terminate Service entirely. If terminated, the Owner will cooperate with Users to enable data withdrawal under applicable law.
Service unavailability may result from outside causes beyond Owner control, such as labor actions, infrastructure breakdowns, or blackouts.
Service Reselling
Users may not reproduce, duplicate, copy, sell, resell or exploit any portion of Retirable, Inc. without express prior written permission from the Owner.
Privacy Policy
Users should refer to Retirable, Inc.’s privacy policy for Personal Data use information.
Intellectual Property Rights
All intellectual property rights — including copyrights, trademarks, patents, and design rights — related to Retirable, Inc. are the exclusive property of the Owner or its licensors and are protected by applicable laws and international treaties.
All trademarks, marks, trade names, service marks, word marks, illustrations, images, and logos appearing in connection with Retirable, Inc. are the exclusive property of the Owner or its licensors and are protected by applicable law and international intellectual property treaties.
Changes to These Terms
The Owner reserves the right to amend or modify these Terms at any time with appropriate User notice. Changes affect the relationship prospectively only.
Continued Service use signifies User acceptance of revised Terms. Users who don’t accept changes must stop using the Service. Failure to accept may entitle either party to terminate the Agreement.
The applicable previous version governs prior relationships. Users can obtain previous versions from the Owner.
Assignment of Contract
The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract rights or obligations under these Terms, considering User legitimate interests.
Users may not assign or transfer their rights or obligations without Owner written permission.

Severability
If any provision becomes invalid or unenforceable under applicable law, that provision’s invalidity doesn’t affect remaining provisions, which remain in full force.
US Users
Invalid or unenforceable provisions will be interpreted, construed, and reformed as reasonably required to render them valid and consistent with original intent. These Terms constitute the entire Agreement between Users and the Owner and supersede all prior agreements regarding this subject matter.
Governing Law
These Terms are governed by the law of the place where the Owner is based, without regard to conflict of laws principles.
Venue of Jurisdiction
Exclusive competence to decide controversies resulting from or connected to these Terms lies with courts where the Owner is based.
US Users — Jury Waiver and Class Action Waiver
Each party specifically waives any right to trial by jury in any court in connection with any action or litigation.
Any claims under these terms shall proceed individually and no party shall join in a class action or other proceeding with or on behalf of others.
Surviving Provisions
Upon termination, the following provisions survive:
- User’s license grants under these Terms survive indefinitely
- User’s indemnification obligations survive for five years from termination date
- Warranty disclaimers and limitation of liability provisions survive indefinitely
